Welcome to Baseball’s Unlikely. These Terms & Conditions (“Terms”) govern your use of this website and your purchase of products from us. By accessing this site or placing an order, you agree to these Terms. Please read them carefully. If you do not agree, please do not use this site or place an order.
In these Terms, “we,” “us,” and “our” refer to Baseball’s Unlikely; “you” and “your” refer to you, the site visitor or customer.
1. Products
We sell books and related printed products, including Baseball’s Unlikely: A Constant (Game 1 and Game 2), the Game 1 & 2 bundle, and team editions. Many copies are autographed by the author.
We make every effort to display our products, descriptions, and photographs as accurately as possible. Actual covers, colors, and finishes may vary slightly due to printing and your device’s display. Autographs are applied by hand and will vary from copy to copy.
All products are subject to availability. We reserve the right to discontinue any product at any time.
2. Pricing & Payment
All prices are listed in U.S. dollars (USD) and do not include shipping or a payment processing fee, both of which are calculated and shown at checkout. A payment processing fee is added to each order to help cover the cost of secure card payment processing. This fee is displayed as a separate line item during checkout before you complete your purchase, and by placing your order you agree to it.
We reserve the right to correct any pricing errors and to change prices at any time without notice. The price that applies to your order is the price displayed at the time your order is placed and confirmed.
Payments are processed securely through our third-party payment processor (Stripe). We do not store your full payment card details on our servers. By submitting payment, you represent that you are authorized to use the payment method provided.
We reserve the right to refuse or cancel any order, including orders that appear fraudulent, are placed in error, or cannot be fulfilled. If we cancel an order after payment, we will issue a full refund.
3. Shipping & Delivery
We currently ship within the United States only.
Shipping costs are calculated at checkout based on the items in your order. We make every reasonable effort to ship orders promptly and to provide accurate delivery estimates, but delivery times are not guaranteed and may be affected by the carrier, weather, holidays, or other factors outside our control.
Risk of loss passes to you upon delivery to the carrier. If your order is lost or damaged in transit, see Section 4.
4. Returns, Refunds & Replacements
All sales are final. We do not accept returns or offer refunds for buyer’s remorse, change of mind, or ordering the wrong item. Because many of our books are autographed and personalized, they cannot be resold and are not eligible for return.
Defective or damaged items. If your book arrives defective, misprinted, or damaged in shipping, we will replace it at no cost to you. To request a replacement, contact us within 14 days of delivery at scott@baseballsunlikely.com with your order number and clear photographs of the damage or defect. Once verified, we will ship a replacement copy. If a replacement is unavailable, we will issue a refund for the affected item.
Lost shipments. If tracking indicates your order was not delivered, contact us within 14 days of the expected delivery date and we will work with you and the carrier to resolve it, including shipping a replacement where appropriate.
This section does not limit any rights you may have under applicable law.
5. Intellectual Property
All content on this website — including the books and their contents, text, photographs, cover art, graphics, logos, and the “Baseball’s Unlikely” name — is the property of the author and/or Baseball’s Unlikely and is protected by United States and international copyright and trademark laws.
Your purchase of a book grants you ownership of that physical copy for personal use only. It does not transfer any copyright or other intellectual property rights. You may not reproduce, scan, distribute, resell commercially, or create derivative works from the book’s contents without our prior written permission.
You may not copy, reproduce, or reuse any content from this website without permission.
6. Acceptable Use
You agree to use this website only for lawful purposes. You may not use the site in any way that could damage, disable, or impair it, interfere with any other party’s use of it, or attempt to gain unauthorized access to any part of the site, its servers, or connected systems.
7. Disclaimer of Warranties
This website and its contents are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, regarding the website. This does not affect the replacement commitment for defective physical products described in Section 4.
We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the fullest extent permitted by law, Baseball’s Unlikely and the author shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website or your purchase of any product. Our total liability for any claim arising from a product or order shall not exceed the amount you paid for that order.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
9. Third-Party Links
This website may contain links to third-party websites (such as social media). We are not responsible for the content, policies, or practices of any third-party sites. Accessing them is at your own risk.
10. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent changes. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.
